These Terms and Conditions constitute a legally binding agreement between you and Tempora Guild regarding your use of our watch repair and maintenance services. By engaging our services or accessing our website, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, please do not use our services.

2. Definitions

For the purposes of these Terms:

  • "We," "Us," "Our" refers to Tempora Guild
  • "You," "Your," "Client" refers to the individual or entity using our services
  • "Services" refers to all watch repair, maintenance, assessment, and related services we provide
  • "Timepiece" or "Watch" refers to the mechanical watch submitted for service
  • "Agreement" refers to these Terms and Conditions along with any service-specific documentation

3. Service Description

Tempora Guild provides professional watch repair and maintenance services including but not limited to:

  • Precision timekeeping assessments
  • Heritage movement restoration
  • Water resistance renewal
  • Component replacement and repair
  • Movement cleaning and regulation

Service availability and specific procedures are subject to our professional assessment of each timepiece. We reserve the right to decline service if we determine the work is beyond our capabilities or would not serve the client's interests.

4. Service Eligibility

You must be at least 18 years of age to enter into this agreement. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts.

5. Service Process and Timeline

When you submit a timepiece for service:

  1. We conduct an initial assessment and provide an estimate for recommended work
  2. Work proceeds only after your written or verbal authorization
  3. If unexpected issues are discovered during service, we contact you before proceeding with additional work
  4. Service timelines are estimates based on typical procedures and may vary due to component availability or technical complexity
  5. Upon completion, we provide documentation of work performed and recommendations for ongoing care

While we strive to complete services within estimated timeframes, we cannot guarantee specific completion dates. Complex restorations may require extended time to ensure proper execution.

6. Pricing and Payment

Service fees are as follows:

  • Published service prices represent standard procedures for typical timepieces
  • Additional charges may apply for component replacement, complex complications, or vintage pieces requiring specialized attention
  • Estimates are provided in Malaysian Ringgit (MYR)
  • Payment is due upon completion of service before the timepiece is returned
  • Accepted payment methods include cash, bank transfer, and major credit cards
  • For services requiring component sourcing, a deposit may be requested

Prices are subject to change without notice, though quoted prices for authorized work will be honored.

7. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about the timepiece's history and any known issues
  • Disclose any modifications or previous repairs that may affect service
  • Respond to our communications regarding service progress in a timely manner
  • Collect your timepiece within 60 days of completion notification
  • Inform us immediately if you discover any issues following service completion

8. Ownership and Possession

You warrant that you are the legal owner of the timepiece submitted for service or have proper authorization from the owner. We reserve the right to refuse service or contact authorities if we suspect a timepiece may be stolen property.

Timepieces not collected within 60 days of completion notification may incur storage fees. After 180 days, unclaimed timepieces may be subject to disposal in accordance with Malaysian law.

9. Service Warranty

We stand behind our workmanship:

  • Work performed carries a 12-month warranty against defects in our service
  • Warranty covers labor and any parts we installed that prove defective
  • Warranty does not cover damage from misuse, accidents, unauthorized repairs, or normal wear
  • Water resistance ratings may degrade over time due to gasket aging; annual testing is recommended
  • Vintage components and original parts carry no warranty beyond proper installation

To claim warranty service, you must present the original service documentation and the issue must be reported within the warranty period.

10. Limitations of Liability

While we exercise professional care in all services:

  • We are not liable for pre-existing damage, hidden defects, or issues not discoverable through standard examination
  • Our liability for any service is limited to the fees paid for that specific service
  • We maintain insurance for timepieces in our care, but coverage limits may not match the full value of high-value pieces
  • Clients with timepieces valued above MYR 50,000 should discuss additional insurance arrangements
  • We are not liable for sentimental value or indirect damages resulting from service delays

Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply in full to your situation.

11. Disclaimers

Important limitations on our services:

  • Services are provided on an "as is" and "as available" basis
  • We make no guarantees about specific timekeeping accuracy outcomes, as results depend on movement condition and design tolerances
  • We do not guarantee component availability, particularly for discontinued or vintage timepieces
  • Assessment opinions represent our professional judgment but are not guarantees of service outcomes
  • We are not affiliated with or authorized by watch manufacturers unless specifically stated

12. Intellectual Property

All content on our website, including text, images, logos, and service documentation, is the property of Tempora Guild and protected by Malaysian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

13. Refund Policy

Our refund policy reflects the nature of service work:

  • Assessment fees are non-refundable once the assessment has been performed
  • If you decline to proceed with recommended service after assessment, no refund of assessment fees is provided
  • Deposits for component sourcing are refundable if we are unable to obtain the specified parts
  • If we determine during service that the work cannot be completed as quoted, you will be charged only for work actually performed
  • Warranty service is provided at no additional charge when applicable

14. Privacy and Data Protection

15. Termination

Either party may terminate this agreement under certain circumstances:

  • You may withdraw your timepiece from service at any time, though you remain responsible for payment of work completed to that point
  • We may decline to complete service if we determine continued work would not serve your interests or if payment is not received as agreed
  • We may refuse future service to clients who violate these terms or engage in abusive behavior toward our staff

16. Dispute Resolution

In the event of any dispute arising from our services, we encourage direct communication to reach a mutually satisfactory resolution. If informal resolution is unsuccessful, any disputes shall be resolved through the courts of Malaysia in accordance with Malaysian law.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia. Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Penang, Malaysia, and you consent to the jurisdiction of such courts.

18. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Changes to Terms

We may revise these Terms and Conditions from time to time to reflect changes in our services or legal requirements. Material changes will be communicated through our website or via email to clients with active services. Continued use of our services after such changes constitutes acceptance of the modified terms.
